Common questions

Accident at work claims FAQ

Everything you need to know about making a workplace injury claim. Can't find your answer? Call us on 0333 006 8282.

You may be able to claim if your employer or another responsible party failed to take reasonable steps to keep you safe and that failure caused your injury. Compensation is commonly handled through employers' liability insurance.

Call us on 0333 006 8282 and we'll check the initial details. It's No Win, No Fee¹.

Potentially. Eligibility depends on what happened, who was responsible, the evidence available and the applicable time limit. Claims generally need to be started within three years, although exceptions can apply. Call us on 0333 006 8282 and we'll explain the next step.

Compensation depends on your injuries and circumstances. Minor back injuries typically range from £2,300-£11,730, while serious injuries like crush injuries or spinal damage can be worth significantly more. You can also claim for lost earnings, medical bills, and ongoing care costs.

Making a claim should not automatically mean losing your job. Employment protections may apply, particularly if you are treated unfairly after raising a health and safety concern, but the position depends on the circumstances. If you're worried about retaliation, Acas or an employment solicitor can provide independent guidance.

You may still be able to claim if you were partly responsible. This is called contributory negligence. Any compensation may be reduced to reflect your share of responsibility.

Your employer's duties do not automatically disappear because you may also have contributed to the accident.

You generally have three years from the date of a workplace accident to start a claim, although exceptions can apply. For an occupational illness, time may run from the date you first knew, or could reasonably have known, that the condition was linked to your work. A solicitor can confirm the deadline for your circumstances.

According to the Health and Safety Executive, an estimated 680,000 workers sustained non-fatal workplace injuries in 2024/25, while employers reported 59,219 non-fatal employee injuries under RIDDOR.

HSE's finalised figure records 128 workers killed in work-related accidents in 2024/25. These figures show how serious workplace risks remain.
