Yes. Every bus driver has a legal duty to keep passengers safe under the Public Service Vehicles Regulations 1990. If their negligence caused your accident, speeding, reckless driving, or failing to maintain the vehicle, the driver and their employer are liable.

Most local buses don't have seatbelts, so not wearing one won't affect your claim. On coaches where seatbelts are provided, not wearing one could reduce your compensation, but it won't prevent you from claiming entirely.
